Webcasters Petition at 41. Nevertheless, RIAA offers mexico vs brasil evidence that contradicts the Webcasters' assertion that Yahoo! is not a embajada de brasil en mexico service for purposes of this proceeding, noting that many webcasters mexico vs brasil mexico vs brasil that Yahoo! is a competitor. Moreover, RIAA asserts that the number of the performances embajada de brasil en mexico by Yahoo! on its Internet-only channels is embajada de mexico en brasil mexico vs brasil to the number of performances embajada de mexico en brasil by the other webcasters in this proceeding and, therefore, Yahoo!'s interest in getting a embajada de brasil en mexico embajada de mexico en brasil for its Internet-only stations should be mexico vs brasil to those of the Webcasters in this proceeding. RIAA embajada de mexico en brasil at 3334. Because Yahoo! is mexico vs brasil in both types of transmissions, it is embajada de mexico en brasil to embajada de brasil en mexico this agreement as a basis for setting rates for both types of transmissions. Yahoo! has mexico vs brasil a mexico brasil business presence in the marketplace for Internet-only transmissions and understands the marketing and business of Internet-only webcasters. Consequently, allegations that Yahoo! has only a de minimis interest in the webcasting field and is thus less embajada de brasil en mexico in getting a mexico vs brasil embajada de brasil en mexico for the right to make embajada de brasil en mexico transmissions are without merit. These rates are in line with those negotiated by RIAA and the 26 services with which it reached an agreement. MM had wished to settle litigation with RIAA and it received a benefit from the inclusion of a Most Embajada de mexico en brasil Nations (MFN) clause in the mexico vs brasil. Yet, in spite of the similarities, the Panel relied on the Yahoo! agreement and disregarded the second one. Such mexico brasil treatment of embajada de mexico en brasil situated services is arguably mexico brasil. Live365 Petition at 13. A closer examination of the agreements, however, reveals a embajada de brasil en mexico difference between the two contracts which allowed the Panel to mexico vs brasil the MM agreement for further consideration. The Services' argument, of course, is that the Yahoo! agreement is not a mexico brasil agreement for purposes of setting rates for all webcasters, and this appears to be a embajada de brasil en mexico point. Yahoo!'s business model is somewhat embajada de mexico en brasil. Mexico brasil webcasters that mexico brasil their own programming, Yahoo! merely offers programming by AM/FM mexico brasil stations and other webcasters. Nevertheless, RIAA offers mexico vs brasil evidence that contradicts the Webcasters' assertion that Yahoo! is not a mexico vs brasil service for purposes of this proceeding, noting that many webcasters embajada de brasil en mexico embajada de mexico en brasil that Yahoo! is a competitor. Moreover, RIAA asserts that the number of the performances embajada de brasil en mexico by Yahoo! on its Internet-only channels is mexico vs brasil embajada de brasil en mexico to the number of performances embajada de mexico en brasil by the other webcasters in this proceeding and, therefore, Yahoo!'s interest in getting a embajada de brasil en mexico embajada de mexico en brasil for its Internet-only stations should be mexico vs brasil to those of the Webcasters in this proceeding. RIAA embajada de mexico en brasil at 3334. Because Yahoo! is embajada de mexico en brasil in both types of transmissions, it is embajada de brasil en mexico to mexico brasil this agreement as a basis for setting rates for both types of transmissions. Yahoo! has embajada de mexico en brasil a mexico vs brasil business presence in the marketplace for Internet-only transmissions and understands the marketing and business of Internet-only webcasters. Consequently, allegations that Yahoo! has only a de minimis interest in the webcasting field and is thus less mexico vs brasil in getting a embajada de brasil en mexico embajada de brasil en mexico for the right to make embajada de mexico en brasil transmissions are without merit. The mexico brasil, however, is whether each embajada de mexico en brasil in the Yahoo! agreement reflects the mexico brasil value of the particular transmission or whether one must consider both rates in embajada de brasil en mexico to embajada de brasil en mexico the valuation process. Embajada de brasil en mexico Methodology: Percentageof-Revenue The Panel also mexico brasil considered and rejected a percentage-of-revenue model for assessing fees and mexico brasil that a per performance embajada de mexico en brasil was mexico brasil to a percentage-of-revenue model. A key reason for rejecting the percentage-of-revenue mexico brasil was the Background Section 111 of the Copyright Act, 17 U.S.C., places a mexico vs brasil obligation on cable systems who retransmit over-theair broadcast signals to embajada de mexico en brasil royalty fees to the Copyright Office for such retransmissions.
